Terms of Service

These Terms of Service ("Terms") govern your use of the Today's Take mobile application ("App"), operated by Todays Take Ltd, a company incorporated in England and Wales (company number 17193304, registered office 124 City Road, London, EC1V 2NX) ("we", "us", "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. What the App Does

Today's Take is a daily photo competition. Each day a prompt is published and you may submit one photo in response. Other users then vote on the submissions during a voting period. Top photos earn points and badges on a public leaderboard.

2. Your Account

You must be at least 16 years old to use the App. When you sign up we ask for your date of birth and verify that you meet this minimum age. We apply this threshold globally to keep the App simple and consistent across all jurisdictions. You are responsible for keeping your login credentials secure. One account per person. You may sign in using Apple Sign-In or Google OAuth; by doing so, you authorise the relevant provider to share your identity token, email address, and (where applicable) display name with us. 3. Your Content

You retain ownership of the photos you submit. By submitting a photo, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, resize, and distribute it within the App for the purpose of running the competition (including showing it to other users for voting, on leaderboards, in feeds, and in the daily archive). This licence also covers public share landing pages you generate when you choose to share your photo outside the App via a link. This licence terminates when you delete your account or remove the photo, except to the extent copies remain temporarily in CDN caches (typically up to 72 hours) or in backups retained for disaster-recovery purposes.

Marketing and promotional use. Separately, when you choose to submit a photo to a public competition, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that photo in our own marketing and promotional materials — for example in app-store listings, on our website and social-media channels, and in advertisements for the App — across any media. We will only use a photo in this way where no identifiable individual appears in it: we will never use a photo in which a person's face is visible, or in which a person is otherwise identifiable, whether as the subject of the photo or in the background. We will not display your username, or any other information identifying you, alongside the photo in marketing materials. If you delete the photo or your account, we will stop using it in new marketing materials, but photos already incorporated into materials published before deletion may remain in those materials. You can ask us not to use a particular photo for marketing by emailing admin@todaystake.app.

4. Acceptable Use

You agree not to submit content that is illegal, abusive, hateful, sexually explicit, or that infringes on the rights of others. You must not attempt to manipulate votes using multiple accounts, bots, or coordinated voting. You must not use the App for any purpose prohibited by applicable law.

5. Automated Moderation

Submitted photos are screened by an automated moderation system powered by OpenAI's omni-moderation model. To run the check, we pass a temporary URL of your photo to OpenAI; OpenAI downloads and analyses the image. OpenAI receives the image itself but does not receive your username, email, or any other identifier from us. Under OpenAI's standard API policy, OpenAI may retain the image for up to 30 days for abuse-monitoring purposes; the image is not used to train OpenAI's models. If the system flags your photo with high confidence, the submission is rejected automatically. Where this happens, you will see a brief statement of reasons (which category was flagged) inside the App. You may contest any decision by emailing admin@todaystake.app; we will manually review and respond within 30 days. You have the right under GDPR Article 22 to obtain human intervention, express your point of view, and contest the decision.

6. Voting and Scoring

Votes are only counted if you also submitted a photo for that day's prompt. Attempting to manipulate votes will result in account suspension. We may remove content or suspend accounts that violate these rules at our discretion.

7. Content Moderation and Reporting

We are a hosting service for user-generated content under the EU Digital Services Act (DSA) and equivalent UK regimes. Anyone (whether or not you have an account) may submit a notice of illegal content via admin@todaystake.app or via the in-app report button. We will acknowledge receipt, review the notice promptly, and let you know the outcome where possible. Where we remove content following a notice, or as a result of automated moderation, we will tell the affected user (a) what was removed, (b) why, and (c) how to contest the decision. Our designated point of contact for users and member-state authorities under DSA Articles 11–12 is admin@todaystake.app and the postal address 124 City Road, London, EC1V 2NX.

8. Advertising and Sponsorship

Some daily prompts may be sponsored by third parties. Any sponsored prompt will be clearly labelled as such inside the App, including the identity of the sponsor. We do not share your personal data with sponsors; sponsors receive only aggregate, non-identifying metrics about how users engaged with the sponsored prompt. We do not run programmatic ads and do not use third-party advertising SDKs.

9. Availability

We aim to keep the App running smoothly but do not guarantee uninterrupted access. We may update, modify, or discontinue features at any time.

10. Limitation of Liability

The App is provided "as is". To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law. If you are a consumer in the EU/EEA, these Terms do not affect any mandatory consumer-protection rights available to you under the laws of your country of residence.

11. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. If you are a consumer in the EU/EEA, you will also benefit from any mandatory provisions of the law of your country of residence, and nothing in these Terms affects your right to rely on them. For EU consumers, the European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr. We are willing to participate in the ODR process where required by applicable law.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App at least 30 days before the changes take effect. Continued use after the effective date of changes constitutes acceptance. If you do not agree with any changes, you may delete your account before they take effect.
